Povzetek: V prispevku je obravnavana delodajalčeva odškodninska odgovornost za škodo zaradi stresa na delovnem mestu. V zadnjih nekaj desetletjih se v strokovni literaturi poudarjata prisotnost in vpliv stresa v vsakdanjem življenju. Sam izvor stresa ni enoplasten pojem, saj gre za splet različnih dejavnikov, ki sestavljajo svojevrsten konglomerat. Pogosto je glavni vzrok (predvsem negativnega) stresa ravno služba, ki jo opravljamo. V prispevku smo ugotovili, da se tako nacionalni kot mednarodni pravni viri s področja varnosti in zdravja pri delu nanašajo tudi na obravnavo stresa z vidika njegovega negativnega vpliva na zdravje ter da je delodajalec po pravilih o neposlovni (deliktni) odškodninski odgovornosti in tudi po pravilih o poslovni odškodninski odgovornosti lahko odgovoren za škodljive posledice stresa na delovnem mestu.

Abstract: The paper examines the employer''s tort liability for damages caused by work-related stress. In the last few decades, there has been a significant recognition of stress in scientific and in popular literature. According to the pathophysiological definition, stress is "a state in an environment or an organism that potentially or actually threatens the integrity or life of an organism". The very source of stress is not a single concept, but is a web of various factors that form a peculiar conglomerate. Often, the leading cause of stress (especially negative) lies in our professional life. It has been established in the paper that both national and international legislation that regulates health and safety at workplace also refers to stress as a negative impact on health. Furthermore, the employer is, according to the rules of non-contractual tort liability and the rules of contractual tort liability, responsible for the harmful effects of stress at work.
