Povzetek: Avtorica v prispevku prikaže starejšo sodno prakso Sodišča EU s področja svobode ustanavljanja, in sicer od zadeve Segers iz leta 1986 pa vse do zadeve Cadbury Schweppes iz leta 2006. Nabralo se je namreč že kar nekaj odločb, ki skupaj z relevantnimi določbami Pogodbe o delovanju Evropske unije tvorijo pravni okvir ustanavljanja gospodarskih družb, njihovega čezmejnega podjetniškega udejstvovanja in preoblikovanja na ozemlju druge države članice. Povod za zbiranje in predstavitev bistvenih sporočil posameznih sodnih odločb je bila zadnja sodba v tej vrsti, v zadevi Polbud, o kateri je Sodišče EU odločilo oktobra 2017. Ta bo skupaj z zadevami Cartesio, National Grid Indus in VALE predmet obravnave prispevka, sprejetega v objavo v eni od naslednjih številk.

Title: Earlier Case Law of the Court of Justice on Freedom of Establishment

Abstract: The article discusses the case law of the Court of Justice on the freedom of establishment, from the Segers case of 1986 to the Cadbury Schweppes case of 2006. A number of decisions, together with the relevant provisions of the Treaty on the Functioning of the European Union, form the legal framework for the setting-up of companies, their cross-border business activities and conversions in the territory of another Member State. The reason for the review of the main conclusions of individual judgments is the latter judgment on the freedom of establishment, i.e. in the Polbud case of October 2017. It will be dealt with in one of the next issues of this publication, together with the Cartesio case, the National Grid Indus case and the VALE case.
