Povzetek: V pretežno adversarnem modelu kazenskega postopka je proces iskanja resnice o preteklem dogodku odvisen od sposobnosti obrambe, da aktivno išče in zbira razbremenilne dokaze. Ta sposobnost pa je odvisna od vsaj približne enakosti preiskovalnih orodij/orožij. V položaju, ko imamo na eni strani opravka z neomejenimi finančnimi in drugimi možnostmi državnega aparata, ki so na voljo policiji in tožilstvu, na drugi strani pa posameznika, katerega možnosti, da financira obrambo svoje nedolžnosti, so vselej omejene, pa o enakosti orožij pri zbiranju in zavarovanju dokazov v kazenskem postopku praktično ne moremo govoriti in je ni mogoče na noben način doseči. Ker teoretične predpostavke, na katerih temelji adversarni model kazenskega postopka, v praksi ne držijo, je sodna kontrola oziroma možnost zbiranja in zavarovanja dokazov po uradni dolžnosti s strani preiskovalnega sodnika v okviru sodne preiskave, kot jo pozna tudi slovenski kazenski proces, edini ustrezni mehanizem pri prizadevanju za iskanje objektivne resnice o preteklem dogodku, za katero dejansko ni nobene prave alternative. Indeed, this seems to depend on a rough equality of investigative arms. In a situation in which the state has almost unlimited resources of investigation and an individual is faced with only limited funds that are available to them for their defence, we cannot really speak about the equality of arms. Since the theoretical adversarial procedural assumptions about the equality of investigative arms in pre-trial police investigation do not exist in practice, judicial control and supervision over evidence collection and ex officio possibility of investigative judge to collect the relevant evidence during court investigation, as also known in the Slovenian criminal procedure, seems to be the only plausible tool in the process of truth-finding, for which there is no alternative.
