Povzetek: V okviru strokovnih priprav za sprejetje nove stanovanjske zakonodaje in celovito zakonsko ureditev upravljanja stavb v etažni lastnini je eno najpomembnejših vprašanj ureditev vloge in položaja upravnika večstanovanjske in druge stavbe v etažni lastnini. Avtor kritično predstavi sedanjo zakonsko ureditev upravnikove vloge, nalog in pooblastil in jo primerja s podobnimi ureditvami v nekaterih drugih državah. Težišče prispevka je na predstavitvi predlogov glede bodoče zakonske ureditve pojma in obveznosti imenovanja upravnika, njegovega položaja in pooblastil, navzkrižja (konflikta interesov) med upravnikom in etažnimi lastniki, določitev pogojev za opravljanje poslov upravnika ter dobe imenovanje upravnika za določen ali nedoločen čas in prenosa poslov z dosedanjega upravnika na novega. The author critically presents the current legislative regulation of the building manager''s role, tasks and authorisations, comparing it to similar regulations in some other countries. The article focuses on the presentation of proposals for future legislative arrangement of the concept and obligations of appointment of building manager, building manager''s position and authorisations, conflicts of interest between building manager and strata-title owners, definition of criteria for conducting business of a building manager, the duration of appointment of a building manager for a fixed or indefinite period, and transfer of building management operations from a current to a new building manager.
