Dokazni predlogi v splošnem in posebnih upravnih postopkih

Povzetek: Razprava kaže, da je treba opozoriti na nekatere posebnosti, ki izvirajo iz narave upravnih postopkov. Navedeno pa v povezavi s pravico stranke do predlaganja dokazov vodi do sklepa, da ima uradna oseba poleg možnosti zavrnitve navedenih predlogov iz razlogov, ki jih sicer poznajo procesne ureditve sodnih postopkov (ker je dokaz nerelevanten, neprimeren ali nepotreben), v upravnem postopku možnost zavrniti dokazni predlog tudi na podlagi vnaprejšnje dokazne ocene. S tem pa po tu zastopanem mnenju glede na specifičnosti upravnega postopka tudi ni poseženo v pravice stranke do poštenega postopka, saj je njene dokazne predloge upravni organ dolžan skrbno presoditi in se do njih ustrezno opredeliti, tak zaključek postopka dokazovanja pa z vidika procesnih značilnosti upravnega postopka tudi ne vzpostavlja neenakosti strank postopka v njihovem medsebojnem razmerju. Ključne besede: upravni postopek, dokazni predlog, vnaprejšnja dokazna ocena, pravica do poštenega postopka Title: Application to Take Evidence in General and Special Administrative Procedures Abstract: The present discussion shows that specific procedural rules derived from the nature of administrative proceedings have to be emphasised. In regard to the right of parties to these proceedings to present evidence, it shows that the official person in charge of administrative procedure has to be able to deny the applications to take evidence not only based on the reasons that are used in judicial procedures (because the evidence is irrelevant, unsuitable or unnecessary), but also based on the anticipated assessment of evidence. In the presented opinion, considering the specific characteristics of administrative decision-making, this does not violate the right of parties to a fair procedure. The application must be duly evaluated and the administrative body has to give reasons for the denial of refusal to take evidence in the procedure. Such a rule for the establishment of facts in administrative procedure also does not cause inequality of parties in their respective positions.
